Our justice system is an adversarial system. It often fosters conflict and enmity. When a couple has children, the partners are not the only people affected by the divorce. Fall out from the divorce, directly and negatively affects their children, no matter how old they might be. It is with the hope of preventing divorce from becoming confrontational and "ugly" that divorce mediation was created. Way before the lawyers commandeered the process of divorce mediation, social workers and family therapists were the mediators because they were the ones best trained to take into account the emotional wounds inflicted by this traumatic and life altering event.
They knew that, no matter how well children seemed to be handling the divorce, the scars they will be carrying with them, as a result of seeing, hearing and experiencing their parents tearing each other apart (as the system demanded), would last a life time.
